Law and Olympic: Contribution to the legal study of a transnational phenomenon

Abstract

National audience Actes of the Colloquium of 4 September 2012, University of Réunion, Faculty of Law and Economics. The Olympic Games are also a meeting of the law: the law of the International Olympic Committee and its famous Charter of ‘constitutional nature’; the law of international federations whose sports are on the programme of the Games; the law of the host country, possibly amended for the event; the law of Switzerland, the law of the territorial seat of Olympic; international soft law, calling for truce, or the UNESCO Anti-Doping Convention, a necessary complement to the World Anti-Doping Code. Between relations of power and legal relations, the Olympic Movement has, beyond the Games, complex relations between dreams of autonomy, to which the General Assembly of the United Nations is not necessarily insensitive, with rights other than its own; the claim of internationality, which the Swiss Confederation deals with in its regard; avoidance strategy, of which the Sports Arbitral Tribunal is a decisive element; normative cooperation through the World Anti-Doping Agency. Olympic and rights, Olympism and Law have all raised questions in Réunion, at the initiative of the Master of Public Law, some of the best sports law specialists surrounded by academics of other specialities. Their exciting thoughts are gathered in this book, coordinated by Professor Mathieu Maisonneuve with the help of Ms Tassadit Yassa (contractual doctoral candidate at the University of La Réunion).
