Abstract

Inspired of the French law, the teacher-researcher's statute in the African law is a set of rules which governs the academic's condition and career but also a text whose adoption obeys a certain formalism. As in France, the teaching statutes are governed by a decree according to the constitutional principle of the distribution of matters between the regulation and the law. The Senegal's case is the exception that proves the rule since the particular statute of November 1981 is a legislative text. Beyond the formal logic or the African political considerations, the stake is too material. The teaching statutes are laconic on the academic liberties. On the contrary, the profession's sociology unveils the political authority's domination through instrumentalization of the rank and the employment's principle of the distinction, the discretionary power and the inability of the African competitive examination's board to erect itself in interpreter of the needs in stations. The necessities of service of the higher education which weigh heavier than the legal condition of those who there contribute and the profession's material declassification relativizes impact of the profession's independence. These constraints explain an academic's hazardous management privileging the recruitment of the contractual staffs or without statute and the complementary hours's abuse. The political challenge is to propose a statute combining within the framework a flexible public order the superior interest of the higher education's graduates and the corporatists requirements of the disciplinary fields's reproduction.
