Indigenous peoples and territoriality: constitutional dynamics in MERCOSUR

Abstract

The aim of this work is to analyse the constitutional rules of Mercosur member countries on the constitutional recognition of the rights of original peoples, focusing on the issue of territoriality. In view of the reality of the complaint by the communities originating from their pre-existing rights to the formation of the present States, we will join us with regard to the right to land and the use and use of natural resources. With the recent formation of the MERCOSUR Parliament, we see new ways of gradually integrating our different legislations, posing a challenge in the face of the effective incorporation of the original peoples as actors in the bloc. We believe that the deepening of the study of our constitutions in dealing with the territoriality of the original peoples will be helpful in estimating the extent to which the work of the Merkosurian Parliament may have on this major outstanding issue.
