The International Court of Justice and international law on reparation. Remarks in the margins of Ahmadou Sadio Diallo (Republic of Guinea v Democratic Republic of the Congo) of 19 June 2012

Abstract

International audience This is an unusual epilogue for the Ahmadou Sadio Diallo case. Opposing Guinea and the Democratic Republic of the Congo over the treatment of the Guinean businessman A.S. Diallo, this case comes to an end with a judgement on the compensation owed by the DRC. In 2010, the Court found that DRC has violated the African Charter on Human and Peoples’ Rights and the International Covenant on Civil and Political Rights, in respect of the conditions in which M. Diallo had been arrested, detained and expelled. More than sixteen years after the very first application filed in the Court’s registry concerning Corfu channel case in 1949, the ICJ gives this 19 June 2012 a judgement on the assessment of reparation.
