Abstract
This article addresses the issue of kidnapping victims in Colombia and the development of case law by the Constitutional Court which, by virtue of the principle of solidarity, ended up outlining a criminal policy that transformed the civil obligations undertaken by the victims prior to their kidnapping. In this respect, it discusses the issue of the autonomy of will in contractual matters, the limits to said freedom, and the resulting consequences under the conception of a social state under the rule of law.
