Abstract
The points of divergence on the interpretation of rights and freedoms between the national and European systems are also fed by the conflict of interpretations on the competent national authorities. This contribution demonstrates how the guarantee of rights has replaced the question of competent national authorities. This lack of interest in questions of competence has produced an interchangeability of constitutional bodies in favor of an accumulation of powers in the hands of the administration.
