Looking at the law of the European Union after the failure of the Constitutional Treaty

Abstract

on 25 March 2007, the Berlin Declaration formalised the abandonment by the 27 Member States of the European Union of the draft Treaty establishing a Constitution for Europe. The aim of this book is to understand the state of European Union law in the context of the institutional and political crisis caused by this failure. It is the result of the communications presented by GERCIE members (Welcome Team 2110, specialising in Community and international law at the University of France — Rabelais de Tours) at a colloquium organised jointly with the German University of Bochum. It contains contributions on the institutional future of the European Union, but also reflections on the resistance of national courts to the primacy of EU law, on the dialogue of judges in the European Union as a whole, as well as on issues relating to the third pillar of the European Union.
