O artigo discute o ativismo judicial do Supremo Tribunal Federal brasileiro e o seu resultado no caso da decisão do RE 466.343-1/SP, cujo precedente paradigmático viola, de modo claro, a cláusula de separação dos poderes e usurpa a titularidade da soberania. Neste sentido, inicia-se o trabalho com uma análise crítica do RE 466.343-1/SP, trabalhando-se, em seguida, com a questão do ativismo judicial, destacando-se o seu conceito, a sua crítica e a sua correlação com as questões sobre o comportamento e a independência dos magistrados. Na sequência, trabalha-se com os efeitos negativos e reprováveis que este ativismo produz sobre a separação dos poderes e a ideia de soberania, para, em seguida, e por fim, destacar-se que o Supremo equivocou-se ao criar a tese da supralegalidade e que ela e a correlata tese sobre os efeitos paralisantes podem trazer efeitos danosos ao ordenamento jurídico.

This article discusses the judicial activism played by Brazilian Supreme Court and its results on the Appeal 466.343- 1/SP, which paradigmatic precedent clearly violates the separation of powers and the sovereignty. Then, the work initiates with a critical analysis of that appeal, working, in the sequence, with the question of judicial activism, making clear its concept, the critics on it, and its relation with the judicial behavior and independence. The third part of the article works on the negative effects produced by the judicial activism over the separation of powers and on the idea of sovereignty, to, then, and finally, detach the error committed by the Brazilian Supreme Court when was created the Supralegality thesis, and that this thesis and the other about the paralyzing effects can bring bad consequences to the legal order.
