The fundamental right to physical culture and sport: a newly constitutionalised economic, social and cultural right in Mexico

Abstract

Summary: The right to sport and physical culture, recognised as fundamental by the Mexican legal system in 2011, is the first step towards its realisation in our country. It is understood as the prerogative of the governor to acquire and develop knowledge relating to his body and movements and to the practice of physical activities, whether by leisure or in a professional capacity under the auspices of the State, the latter being obliged to protect, respect and promote it. But perhaps what matters in the construction of mechanisms to protect this fundamental right is its understanding, on the one hand, in its true aspect as an autonomous right, and, on the other, as a catalyst for the realisation of other economic, social and cultural rights, such as health, education, etc., since this has taken place in the design of public policies (albeit subject to the six-year period) framed by this new approach, which undoubtedly represents a step forward at least in the legal field.
