When Brexit takes place in the municipal elections

Removal of British voters from the electoral roll on 1 February 2020, compulsory resignation of British elected representatives on 1 February 2020, impossibility of campaigning and representing themselves because of their ineligibility, the consequences of the agreement on the withdrawal of the United Kingdom from the European Union for the French municipal elections of 15 and 22 March 2020 are severe. However, they are still uncertain pending an imminent decision by the Council of State and may be taken by the Court of Justice of the European Union... pending an interpretation by the Court of Justice of the European Union of Articles 20 and 22 TFEU, 50 TEU and Articles 10, 12 and 127 of the Withdrawal Agreement, it must be stated that the exclusion of the right to vote and to stand as a candidate for the United Kingdom living in France is not accompanied by an indisputable legal basis (I). In addition to the undermining of democracy and European citizenship, the relationship between Directive 94/80 and the implementation of Article 50 TEU arises. It is thus the legality of the deliberations of the Municipal Councils with a British elected representative taken after the ratification of Brexit that is at stake (II).
