Abstract

National Hearing Since the reform undertaken by Order No 2005-1088 of 1 September 2005, the National Court of Health and Social Pricing (CNTSS) undertook to produce case-law clarifying the new budgetary law for social and medical and social establishments and services (ESSMS), defining the contours of concepts as fundamental as those of the need for the normal operation of the establishment, of the unjustified or excessive nature of expenditure, of the enforceability of a limited allocation, of budgetary convergence or of the enforceability of staff costs generated by the application of approved collective labour agreements. designed to be an effective working tool, this book gives a concrete account of these contributions in the case-law, which are vital at a time when the pricing authorities are looking for the greatest possible rationalisation of resources. For the period from 9 November 2007 to 8 April 2011, each judgment was carefully read and analysed; each of the 18-15 case-law solutions considered interesting has been isolated and expressed as a few phrases.The public: this guide will be of interest to budgetary law practitioners (Directors-General, directors of ESSMS, officials in the charging services, accountants, auditors) and tariff disputes (members of courts, lawyers) to feed into the drafting of initial budgetary proposals, letters from the adversarial procedure and appeals. It will also be of interest to students and professionals who follow a course of management training.
