Abstract
National audience At the beginning of the year, the legislative news is somewhat overshadowing the latest case law: the world of family law — bar, notary, judiciary, ministerial offices — speaks only about the new divorce by mutual consent. It is true that the legislator has hardly been pioneered by practitioners: law No 2016-1547 of 18 November 2016; an implementing decree and a decree of 28 December 2016; a circular issued by the Chancellery on 26 January 2017, accompanied by a dozen technical data sheets and three annexes; the whole of a divorce applicable on 1 January 2017... Even though not pessimistic, delicate questions of law and practice remain to be resolved in order to best apply and accompany this new step in contractualisation, especially since contract law has also just been reformed. The real implementation difficulties, which will require energy and collaboration between all, should not be accompanied by ring-fencing: family justice is a social issue that deserves better than picrocholine wars. Lawyers and notaries, work together to ensure that families continue to believe in the value of the law!
