Linaje, vinculación de bienes y conflictividad en las élites nobiliarias de la España moderna : los conflictos en torno a la sucesión del mayorazgo (XVII-XVIII)

Abstract

The entailed estate was one of the key institutions of the Modern Age, which allowed the transmission of patrimony and the preservation of the memory of the lineage. The first part of this paper deals with the functioning of the entailed estate and its presence in modern institutions. The analysis of the practices of estate entailment within aristocratic families and the wealthy bourgeoisie who, in their cursus honorum, entailed their acquired wealth, allows us to better understand the prevailing social model of the Ancient Régime, in which prestige, honor, status and the desire for perpetuation were fundamental pillars. On the other hand, assets linking was a European phenomenon, and through the substitution fidéicommissaire and the majorat we approach the models of patrimonial transmission predominant in France. The second part of this work is devoted to the litigation over entailed by the entailed estates and a typology of conflicts is established. On the one hand, it deals with the succession disputes between the families and, on the other hand, the disputes arising from the management and administration of the entailed estate. The latter transcended from the family sphere to the social sphere. Finally, the third part of this investigation deals with the products resulting from the conflict over the entailed by the entailed estates, and the construction of new discourses and legal resources used in the judicial process, as well as the symbolic value of the institution. The exhaustive study of this complex, plural and relevant conflict universe reveals the social and economic practices developed around the institution of the entailed estate and how the noble elites revealed their dominant role within the society of the Ancient Régime.
