Access to justice for women in situations of gender-based violence

Abstract

Access to justice is a civil and fundamental right essential to ensure equality between citizens of a state. We will address the main obstacles faced by women victims of gender-based violence in accessing, remaining in, and achieving a beneficial outcome. We will also concentrate on the point of contact with the judicial bodies and their operators, i.e. the time of the complaint. But what is access to justice and what are these obstacles? Who assists victims during this process? What happens when they are not heard? Where do they visit? What role does the state play? Access to justice is a joint action of the three branches of the State, which means that the judiciary is responsible for the administration of justice, and it is the executive and the legislature that must equip the former with the means and resources necessary to guarantee access, within a reasonable period of time and cost. It is also the responsibility of the legislature to sanction legislation that makes this access more effective and essentially has a gender perspective. Faculty of Legal and Social Sciences
