New Latin American constitutionalism and political philosophy: the need for sited and critical thinking in order to recast our constitutional bases

Abstract

The recent experiences of the political processes in Venezuela, Bolivia and Ecuador have adopted new constitutions which represent an important turning point in relation to regional constitutionalism and require a theoretical constitutional approach that goes beyond the traditional frameworks of demoliberal constitutionalism and even of the neo-constitutionalism of the North American euro Atlantic matrix. This is why, on the basis of this work, we intend to reflect on the need to develop a constitutional approach to the realities of our region, which is therefore critical and that we believe that we are better suited to the new constitutional agenda that the aforementioned processes are opening up in South America. From this point of view, we are seeking to make the people concerned visible as a player in constitutional practices and to restore the constitution itself to its status as a ‘popular code’ in a democratic society.
