Criminal Code 13th edition

Abstract

This Code contains most of the texts — international, constitutional, legal and regulatory — applicable in criminal matters. It does not purport to be exhaustive, but groups together the most commonly used provisions. The texts were updated on 1 September 2011. They therefore include in particular: — the Law of 29 December 2010 amending Article 47g of the Code of Criminal Procedure concerning cooperation with foreign infiltors; the Royal Decrees of 8 April 2011 determining the date of entry into force and implementation of various provisions of Titles III, V and VII of the Law on Principles of 12 January 2005 concerning prison administration and the legal status of prisoners; — the Law of 14 April 2011 laying down various provisions (1) and the Law of 11 July 2011 amending Articles 216a and 216ter of the Code of Criminal Procedure and Article 7 of the Law of 6 June 2010 introducing the Social Criminal Code — the Law of 1 June 2011 prohibiting the wearing of all garments wholly or principally concealing the face — the Law of 14 July 2011 amending the Law of 7 July 2002 containing rules on the protection of witnesses at risk and other provisions. The Moniteur belge of 5 September 2011 published the Law of 13 August 2011 amending the Code of Criminal Procedure and the Law of 20 July 1990 on pre-trial detention in order to confer rights, including the right to consult and be assisted by a lawyer, on any person interviewed and on any person deprived of liberty (‘Salduz’ Law). As this law is of paramount importance, we have decided to include it already in this code under the relevant provisions, although its entry into force is only scheduled for 1 January 2012.
