Abstract

This book provides an in-depth analysis of Belgian insurance law. The author develops in turn the provisions common to all insurance contracts, the rules governing indemnity and lump-sum insurance, insurance against damage and personal insurance. There are chapters on co-insurance and reinsurance, as well as on insurance intermediaries. The book also provides insights into European insurance law and supervision regulation. Compared to the previous edition, published in 2010, the book was largely recast. It takes account not only of the many academic and jurisprudential developments which the law of the insurance contract has still undergone, but also of the recent framing of the legislative and regulatory framework. The law of 25 June 1992 on land insurance contracts replaced Part 4 of the Law of 4 April 2014. The latter law also took over the regulation of insurance intermediaries. The system of supervision of insurance undertakings has evolved profoundly, particularly in aspects that directly affect contractual relations, such as the explosion of information requirements and the introduction of ‘conduct of business rules’ imposed on insurers and intermediaries; a new control law was adopted on 13 March 2016. The book also analyses new developments on fundamental rights issues, in particular with regard to the principle of non-discrimination. This Precis de droit des assurances finds its natural extension in the Precis relating to personal insurance, which Professor Jean-Marc Binon publishes at the same time in the 2th edition. The triptych is intended to be supplemented by a Precis relating to damage insurance, which Professors Bernard Dubuisson and Vincent Callewaert will publish at a later stage.
