Social implications of digital justice

Abstract

Neste study analyses the social implications of digital justice. The pandemic crisis has changed the way justice has been administered. It became urgent to find telematically solutions for civil procedure as a whole, making it more agile in the exercise of its innate social and distributive function of justice and the common good. The key objectives were to highlight the corrective measures necessary for the administration of justice, while at the same time determining whether the extraordinary circumstances caused by the pandemic, which led to the application of the digital method, should lead to a new era in civil proceedings and be an opportunity for a fresh start, making it more modern and functional, resilient to any form of pressure or exceptional moment, thus making the digital measures adopted definitive. The methodology used was based on the study of the digital method, its use in courts; the evaluation and selection of judges and lawyers, both of which must have digital knowledge, in addition to a thorough knowledge of the law. The legal instruments governing and legitimising the application of digital justice, new technological means and platforms, artificial intelligence systems and robotics judicial decisions were analysed. While there is still a long way to go, the digitalisation of justice has contributed to its modernisation and increased agility in the various procedural stages, largely overcoming a slow and outdated system. The introduction of artificial intelligence, through software that serves as search engines and databases capable of providing legal advice (machine learning), has proven to be of great value although it raises issues of security and source of data for which no answers have yet been found.
