Das Federal Constitutional Court ruled that Article 3 III 2 of the Basic Law requires legal arrangements to protect people with disabilities from discrimination in the event of a coronavirus outbreak. Above all, the decision makes it clear that, like all fundamental rights, Article 3 III(2) of the Basic Law is also an objective value decision and a duty of protection – a protective duty which may become a legislative duty of protection.
