The VIVIENDA IN PROPIEDAD COMO CAUSA AND VÍCTIMA OF THE HIPOTECARIA CRISIS

Abstract

Detrás of the 2007 US systemic crisis, there are legal bases related to the lack or inefficiency of the characteristic features of a modern territorial system: effective land registration, banking system and mortgage securities. The widespread use of owner-occupied housing has been identified as one of the causes of the crisis and is suffering its consequences; in other words, what changes in its financial aspect affects its aspect as a human right, and vice versa. The article raises the question of how this is influencing the way housing is perceived in our ius-privatised legal system, which has traditionally not given special interest in it. Furthermore, it questions ownership as the only form of actual possession of housing, especially from the perspective of the inherent risks of the reverse mortgage or the externalities it causes in other areas of social reality, such as employment. To this end, the new intermediate holdings in Catalonia are indicated as an alternative.
