The legal and practical framework for investigating crimes against the provision of home-based public services

Abstract

Las home-based public service providers are currently victims of crime that limits their ability to develop the purpose for which they have been created. These companies spend large amounts of money and make tremendous efforts to prevent such behaviour. As a result, they call on the authorities to be more effective in combating these forms of crime, but feel that they do not give them the importance and treatment they deserve. The purpose of this article is not to carry out a dogmatic study of the types of criminal offences that describe the different conduct affecting the provision of public home services. It does not address the issue from the point of view of substantive criminal law. The aim of this work is to study the procedural mechanisms in place in Colombian law to investigate this type of behaviour efficiently and effectively. The issue is addressed from a procedural point of view and, more specifically, from the point of view of the powers and powers of the bodies responsible for the prosecution of these offences, during the investigation phase. In the end, the conclusions obtained consist of a number of recommendations on treatment.
