Business complicity, transitional justice and human rights violations of indigenous peoples in Brazil during the Civil-Military Ditatorship of 1964-1988

Abstract

Este article presents a systematisation of the human rights violations of indigenous peoples in Brazil committed by companies during the civil-military dictatorship (1964-1988), identified by the National Truth Commission. Based on the finding of the existence of two models of development in permanent conflict in Brazil and also in Latin America, the article links the mechanisms and practices relating to transitional justice to the studies and postings developed by human rights and business researchers, who indicate a fourth generation in the transitional studies, by seeking to bring these two areas together under the name ‘Justice for a Corporate Transition or Business Coherence in Transition Justice’. Following this, a systematisation of human rights violations against indigenous peoples committed by companies is carried out on the basis of the Final Report of the Brazilian National Truth Commission. Combining the theoretical benchmark mentioned and the data referred to in that report, it is concluded that a gap still persists with regard to violations against indigenous peoples, which deserves to be highlighted in order to contribute to research and discussions on the transition in Brazil. In order to prepare the article, exploratory research has been used in legal literature and case law, and the inductive method has been prioritised.
