Abstract

I would like to invite you to consider the proposal that rehabilitation [1] is not as beneficial as they have taught us to believe that it is – and has never been. Secondly, I would like to invite you to imagine new relations between criminal justice and social justice, in light of the misleading statements by Prime Minister Cameron and Minister of Justice Grayling about the possibilities of combining punishment with rehabilitation. Both are mistaken for various reasons, but they are fundamentally wrong not to consider that young people, the disabled and the elderly, people without financial resources and those living in destitution are already being severely punished because they belong to communities lacking basic access to housing, employment and fundamental well-being. In such a situation, it seems obvious to me that all issues relating to the crime and its punishment should be linked, and probably understood, in terms of social justice and inequality. It is with this aim in mind that I argue that, instead of punishing disadvantaged classes repeatedly, and then deceive ourselves by believing that we can combine punishment with rehabilitation, we should work towards achieving restorative justice based on a renewed principle of equality before the law. The term ‘rehabilitation’ used in this text, although recorded as a textual translation of the English voice rehabilitation, refers specifically to the concept of the so-called ‘reintegration and resocialisation’ which are the most commonly used in the penal literature of the Spanish language by referring to the functions of the penal and prison system.
