Abstract
Este document presents the results of a fieldwork carried out in 2013, in which the aim was to study the role of sentencing judges in the issue of prison overcrowding. The fieldwork included different investigative methods, such as collection of documentation, analysis of judicial decisions and interviews with judges. The purpose was to identify the legal and social patterns that influence the decision-making of sentencing judges to apply criminal subrogates. Identifying these aspects of sentencing judges is relevant to the debate on prison overcrowding, bearing in mind that it is the latter who decide in recent cases on the application of alternative measures to prison detention.
