Transnational constitutionalism: for a multiversalist understanding of the constitutional state

Abstract

O this article seeks to analyse the basic elements that characterise the formation of so-called transnational constitutionalism. More than a process of globalisation, there is now the development of a new phase of the constitutional movement. As it points to the consolidation of the ideas of universal guardianship of human rights and the defence of peace, international legal integration appears to be much more complex than a simple process of developing international bilateral or multilateral standards. To that end, we will start with a brief historical analysis of the origins of the constitutional state. Next, we will try to find elements that can provide parameters for understanding transnational constitutionalism. Finally, a number of considerations will still be developed with regard to the relationship between the constitutional state and the constitutional principle from a transnational perspective. The first part of the research is guided by the analytical and descriptive method, whereas it is based on a methodology which is remarkably critical in its final part.
