Abstract
O The aim of this work is to identify, on the basis of a case study, symbolic patriarchal demonstrations in the implementation of the Maria da Penha Law, and to analyse, on the basis of the judge’s understanding of the forms of violence against women and the status of women in violence, the challenges to effectiveness in protecting women’s human rights, reflecting on the need for technical empowerment of legal operators in matters of gênero, to deal with all forms of violence against women, as laid down in international legal statutes protecting human rights, and in particular institutional violence, manifested in symbolic violence, reproduced by the State itself, which subjects women to double victimisation.
