Abstract
The legal rhetoric is a technique of argument and a way to build the truth. The legal rhetoric appointed in the article conceives language as a process of construction of the linguistic competence (Understood as the ability of the subject to act linguistically), and is considered the cornerstone of the legal discriminatory practices. We stipulate that I have legal discourse language is a construction in constantly giving, opting us to the idea of language as a given. Legal rhetoric is an argument technique and a way of building the truth. The legal rhetoric proposed in the article sees language as a construction process in which language competence, understood as the subject’s ability to act linguistically, is the fundamental backbone of legal discursive practices. We propose that the speech of legal language is a constantly developing construction, opposing the idea of language as something given.
