Dreptul magistraților la propria imagine

Abstract

The topic of this article is dictated by the reality of the Republic of Moldova, by the connotations which, in our opinion, are much deeper than they appear at first glance. No one disputes the fact that the achievement of an independent, impar- tial, credible and effective judiciary system is a necessary condition for the law supremacy and the principles of rule of law, but at the same time, we must not neglect the rights of magistrates, who are subjected to aggressive media pressure. Both the press as well as the radio or television programs constantly speak about the guarantee- ing the effective independence of the judiciary sys- tem, ensuring the transparency of the justice act, improving the quality of the justice act, increasing the efficiency and the accountability of the judi- ciary, ensuring free access to the justice, improving the efficiency of the juvenile justice, strengthening the dialogue with the civil society and its involve- ment in the reform process, creating the conditions for the juridical cooperation having as aim the inte- gration in the European space of freedom, security and justice, preventing and combating corruption in the judiciary system. The judiciary system as a whole, but also the jud- ges in particular, are the target – actors in these publications or broadcasts. We do not intend to defend or to accuse the opponents, declaring, actually, the same aspirations, but we will review the legislation and the relevant jurisprudence in respecting human rights and adoption of the best European practices.
