Abstract
O This work has been accompanied by a few nuances about the renown that the judiciary of politics and judicial activism in Brazil, more specifically with regard to the right of establishment, has gained. We also address the importance of observing the principle of non-regression of social achievements as a means of guaranteeing social security and order, which are constitutional provisions aimed at maintaining social justice as a whole. This article uses the deductive method using the literature review technique.
