Three aspects of the quality of law

Abstract

Tradycyjnie the quality of the law is linked to compliance with certain rules of law (so-called ‘good legislation’ rules). This thinking is very simplistic. The considerations point out that what is the other is the quality of the law and what is the respect for the rules governing its creation. However, it may still be that the law created in application of good legislation does not necessarily have to be of high (satisfactory) quality. Especially on the assumption that the quality of the law is mainly the level of legal certainty provided. The reasoning is based on the idea that the issue of the quality of the law falls primarily within the sphere of research of the law. In this context, reflections on the quality of law have given rise to the observation that the development of this quality is necessarily associated with the development of the theory of law. As regards the examination of the quality of the law as a measure of safety, the issues that arise are covered in a sketch form in three areas: 1. Quality of law from the point of view of its formation, formogenicity in relation to social phenomena in general, 2. Quality of the right for a person and 3. The quality of the law in judicial activity.
