Abstract
El 27 January 2020, the Inter-American Court of Human Rights declared the Ecuadorian State liable for the violation of rights and guarantees laid down in the American Convention on Human Rights against the citizen Mario Alfonso Montesinos Mejía. Consequently, the Court ordered a series of measures to be complied with by the State responsible for such violations, highlighting the primacy of international law over domestic nationals. The illegal detention of Montesinos Mejía lasted from 1992 to 1998.
