The public prosecutor’s office in search of missing persons: a look at the environment for the burial of unidentified people in the municipality of São Paulo

Abstract

The urban environment, whether in relation to planning or environmental governance and management of burial the public has called for a stronger scientific approach, especially with the strong development of cities. In the defence of citizenship, the experience of the Missing Persons Location and Identification Programme of the Public Prosecutor’s Office of the State of São Paulo – PLID/MPSP led to the finding that scratch ditches, possible necroslurry pouring and entrone contamination socio-environmental, in addition to bad practice for the preservation of bodies of people to be identified or still located by them family members; this affects the most fundamental human rights. Even in those circumstances, the public authority claims that its duty constitutional review would be conditional on ex nunc effect of State Decree No 47.397/2002, which, depending on obviety, is not it maintains. On the agenda, there is also the enactment of Municipal Law No 17.180/2019 and its Decree No 58.965/2019. they do not provide the details of the issue raised here, which is an attack on the protection of the environment and on the Patrimônio Brazilian Cultural Public.
