Abstract

O text addresses, under the theoretical milestone of Criminology developed on the basis of the paradigm of social control, Criminmentea Criminology Criminology and feminist, the functioning of the criminal justice system in relation to sexual violence against amulher (particularly the estupro), pointing to the sovereignty of the patriarchate and the duplication of the violence he causes with him, and the need for the inclusion and co-responsibility of all of us, such as institutional or symbolic co-partners of social and criminal control, in overcoming the mechanical violence, designed in its structural, institutional and intersubjective dimension. This paper points out, under a Theoretical Important moment of Criminology, bedded on social control paradigm, mainly the critical and Feminist Criminology, the operation of criminal justice system regarding sexual violence against woman (Specially rape), Observing patriarchate sovereign and increasing of violence that it has had inside itself, as well as to the inclusion need and co-responsibility of everyone, as an institutional or systemic partner from social and criminal control, on overcoming the violent cemechanics, created in your structural, institutional and interpersonal dimension.
