An iusphilosophical view of the principles of law and the principles of family law

Abstract

La legal philosophy always has something to feed into the analysis of the law. Recently, legal principles have been positivised to achieve greater objectivity in the application of the rules. The principles serve as interpretative criteria within the legal system. Where the judicial decision is intended to have a certain sense of correction, it needs to find a rational basis based on the topical nature of the principles.
