O Labour law arose in the context of disenfranchisement and exploitation of the skippers towards manual workers, this branch of law being the power to discipline and safeguard the rights of the persons with disabilities. However, even if there is a clear development in various legal provisions over time, the rural worker is disappointed as regards the supervision by the State, trade unions, or even the imposition of a cultural issue from which he lives. The purpose of this work was thus to examine what conditions preclude or prevent the implementation of the legislation laid down by the Constitution of the Federative Republic of Brazil so that it can guarantee the social and fundamental rights in human labour relations in the rural sector in the territory of the identity of the Serton Portal of the State of Bahia. The diagnosis of this research has been done through data collection through technical visits and semi-structured interviews, applied to workers and rural communities and representative trade unions, from which it has shown surprising data that more attention should be paid by the social actors involved in order to remedy the lack of implementation of the rules on the rights of these workers.
