The duties of the STATE IN THE PROTECTION OF THE RIGHTS OF VIOLENCE VIOLENCE AND THE GUARANTEE OF ACCESS TO JUSTICE

Abstract

La CEDAW, DEDAW and the Istanbul Convention establish a catalogue of obligations ranging from the protection of victims of gender-based violence to the content of public policies, laws and actions to prevent, detect, protect and punish acts of violence against women. This set of service obligations creates rights for victims, who in turn integrate the right of access to justice for women who have such status. In other words, this range of national and international rules create the objective and subjective content of women’s right to life free from violence and their consequent right of access to justice. These include the duty of due diligence of States, which takes on a twofold dimension of responsibility, namely a systemic dimension and an individual dimension, which in turn relates to social and individual rights, respectively. The concept of ‘due diligence’ takes on great importance in the area of State responsibility
