Abstract
el Constitutional State leads to the emergence of a new rule of law paradigm that fully embraces the theoretical models of Law Science and the categories of law-based science on which it had been built. On the other hand, globalisation also implies a profound change in the dominant legal paradigm resulting in a crisis in the state legal model. In this theoretical and practical context, the question arises as to the future of the Constitutional State and its emancipating content at a time of state and legal science crisis that had supported it, increased interdependence and the dissolution of state borders. Under what conditions can constitutionalism survive these transformations? Abstract: Constitutional State entails theappearance of a new paradigm of State that reachably the theoretical models of Legal Scienceand epistemic categories on this one had beenconstructed. On the other hand, globalizationsimplies also a deep mutation of the juridical paradigm that causes a crisis of thejuridical model of status. In this theoretical context, emerging the question on future of the Constitutional State and of itsemancipating findings in an era of crisis of theState and the Legal Science model that had had given itsupport, of increasing interdependence and dissolution of the state borders.
