Procedural action, between the right to effective judicial protection and access to justice

Abstract

La theory of law is an area which by its very nature faces approaches to the philosophy of law, legal flows and political ideologies. This document seeks to analyse how, in the theory of procedural law, through the concepts of action, effective judicial protection and access to the administration of justice, this battle is transferred between philosophy, legal science and ideology. This article seeks to analyse the categories at issue in order to deconstruct the content of procedural concepts, so that there is a conceptual and analytical difference between those concepts.
