As long as the issue of fundamental rights is addressed, it is based on the reference of the Magna Charter. It is analysed whether or not the provisions of those rights are appropriate and whether they are not sufficient to defend themselves against the infringement, injury or abuse, not importing from some of the parties from whom such actions originate. In this article, I will address the issue of a legal science which has sparked considerable debate on the day. This is international criminal law and its application in the soundtrack Pinochet case. This science has attracted much attention in the world, because it is newly created, not because the case already mentioned is the only one, but the unique application of historically inapplicable rules.
