State of play on political gender-based violence in Mexico: Stereotypes hindering women’s political right to access public office

Abstract

El Current paradigm used by bodies responsible for procuring and administering Justice, in addition to not having a gender intersection view, reproduce stereotypes that perpetuate a patriarchal, misogyn and anquilous culture of roles, reducing and seriously affecting women’s political participation in this way such as their effective access to positions of political representation. This is why the impact and significance in the investigation line will be through the original forensic input. it will provide epistemological tools for the solution of cases, combined with the careful consideration of the main theories that assist in adopting the approach of cross-cutting gender and the human rights of women of political violence: gender against women based on gender intersectionality. The main input of the model is the critical study of the model that is currently being carried out. employs the Electoral Tribunal for the Judiciary of the Federation as well as the Courts premises when sanctioning behaviour related to political gender-based violence. In principle, due to the absence of criminal types and administrative offences in the legislation, but above all, due to the lack of an intersectional gender approach assessing testing under a model that is different from the current one, more flexible and in line with the standards of International laws
