PARADIGMATIC CHANGES IN PHILOSOPHY: Reflections in the search for an ADEQUATE understanding of JURIDIC hermenology and the importance of the PAPEL OF THE CONSTITUCIONAL JURISDATION

Abstract

O This work seeks to analyse how the profound paradigmatic changes in philosophy have been instrumental in reshaping the basis for a proper understanding of legal hermenology in post-modern times. Through this approach, a synthetic approach to the evolution of the topic is initiated on the basis of the classical metaphysical paradigm, following the paradigm of the philosophy of conscience and its overcome by the language and gyro-ontologist. Next, it is noted that law now plays a new role in the Democratic Rule of Law, breaking with the purely regulatory law, to join the model of the right to promote and transform. Finally, it is understood that the model of the right of social promotion and transformation is linked to the interpretative character of the right, represented by a greater requirement in the development of the role of the constitutional jurisdiction, which will break into the embracing of fundamentalists and procedural practitioners.
