Abstract
Desde The criminal sphere provides for a series of safeguards in favour of litigants, but – equally – there is an objective of criminal protection for a society that has the essential objective of protecting and combating crime. In this study, we discuss the relationship between mental illness and life crime, highlighting that – frequently – we confuse mental illness with danger, explaining the crime on the basis of the perpetrator’s infirmity. In this regard, it is necessary to look into the possible conditions associated with the offence (aetiology) and its manifestations (phenomenology), with a view to prevention and treatment.
