Darknet AS A evading SPHERE OF LEGAL REGULATION

Abstract

Правовая the system of Russia in recent decades has obviously faced the challenges of the global electronic network. They are primarily related to the fact that many groups of legal relations that have traditionally existed in the “material” form move to cyberspace. It is not only about large-scale digitalisation of the sphere of purchase and sale, but also of those areas of law in respect of which their movement on the Internet has not been previously foreseen (the sphere of public services, electronic voting law, etc.). The problem of using Darknet in criminal matters is even more daunting. The absence of any systemic legal regulation in this area, and even a minimum set of basic legal terms, renders domestic legislation defenceless against the rapidly developing Darknent. The article offers author’s understanding of the main problematic issues of Darknet as a subject of legal regulation, the correlation of ideas of freedom and anonymity in the network and protection of public and private interests. The formulation of the concept of legal regulation for Darknet should serve as a starting point on that path.
